1. Acceptance of Terms

By accessing or using klikcard ("the Service"), provided by klikcard ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and klikcard regarding your use of the Service. You acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

klikcard is a digital business card platform that enables users to create, customize, and share professional profiles. The Service includes:

  • Digital Business Cards: Create customizable profiles with contact information, social media links, products, services, testimonials, and media galleries.
  • QR Code Generation: Generate and download QR codes linking to your profiles.
  • NFC Products: Physical NFC-enabled cards and products that link to your digital profiles.
  • Analytics: Track profile visits, QR scans, and user engagement (available on select plans).
  • E-commerce: Browse and purchase physical products from our marketplace.
  • Custom Domains: Connect your own domain to your profile (available on select plans).
  • Subscription Plans: Access premium features through Free, Pro, and Ultimate plans.

3. Account Registration

3.1 Eligibility

To use the Service, you must be at least 18 years old or have parental/guardian consent. By registering, you represent that you meet these requirements.

3.2 Account Information

You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and update your information to keep it accurate.
  • Keep your login credentials confidential and secure.
  • Accept responsibility for all activities under your account.

3.3 Account Security

You are responsible for maintaining the security of your account. Notify us immediately at contact@klikcard.com if you discover any unauthorized use of your account or any other security breach.

4. Subscription Plans

4.1 Plan Tiers

klikcard offers the following subscription plans:

  • Free: Basic features with limited profiles, contacts, and storage.
  • Pro: Enhanced features including analytics, increased limits, and custom colors.
  • Ultimate: Full access including custom domains, unlimited features, and priority support.

4.2 Payment

Subscription fees are displayed in your local currency and are payable via cash on delivery or other payment methods we may offer. All fees are non-refundable except as expressly stated in these Terms.

4.3 Plan Changes

You may upgrade or downgrade your plan at any time. Downgrading may result in loss of access to certain features or content that exceeds your new plan's limits.

4.4 Expiration

Subscriptions expire based on the plan duration purchased. Upon expiration, your account will revert to the Free plan, and premium features will be disabled. Content exceeding Free plan limits may become hidden but will be restored if you upgrade again.

5. User Content

5.1 Ownership

You retain ownership of all content you upload, post, or display on your profiles, including but not limited to text, images, logos, contact information, and media files ("User Content").

5.2 License to klikcard

By uploading User Content, you grant klikcard a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of providing the Service to you.

5.3 Content Restrictions

You agree not to upload, post, or display content that:

  • Is illegal, harmful, threatening, abusive, defamatory, or obscene.
  • Infringes any patent, trademark, trade secret, copyright, or other intellectual property right.
  • Contains malware, viruses, or harmful code.
  • Violates any applicable law or regulation.
  • Impersonates any person or entity.
  • Collects personal information about other users without consent.

5.4 Content Moderation

We reserve the right, but not the obligation, to remove or disable access to any User Content that violates these Terms or is otherwise objectionable.

6. Marketplace & Orders

6.1 Product Purchases

The klikcard Marketplace allows you to browse and purchase physical products, including NFC cards, QR code products, and related merchandise. All purchases are subject to product availability.

6.2 Cash on Delivery (COD)

We offer cash on delivery as a payment method. By selecting COD:

  • You agree to pay the full order amount upon delivery.
  • You must be available at the delivery address to receive and pay for your order.
  • Failed delivery attempts may result in order cancellation and restrictions on future COD orders.
  • We reserve the right to require alternative payment methods for orders exceeding certain amounts.

6.3 Shipping

Shipping times and costs vary based on your location and selected products. Estimated delivery times are provided at checkout but are not guaranteed. We are not responsible for delays caused by shipping carriers, customs, or other factors beyond our control.

6.4 Returns and Refunds

Due to the nature of cash on delivery transactions, returns and refunds are handled on a case-by-case basis. Contact us at contact@klikcard.com within 7 days of delivery if you receive a defective or incorrect product. Activated products (such as NFC cards that have been linked to profiles) are not eligible for return.

6.5 Order Cancellation

You may cancel your order before it is shipped. Once shipped, orders cannot be cancelled but may be returned subject to our return policy.

7. NFC & QR Products

7.1 Product Activation

NFC cards and QR products require activation using a unique code provided with your purchase. Each activation code can only be used once and is linked to your account.

7.2 Profile Linking

Activated products are linked to your klikcard profiles. You may change which profile a product links to through your account settings. The physical product remains functional as long as your account is active.

7.3 Product Limitations

  • NFC functionality requires a compatible smartphone or device.
  • QR codes can be scanned by any standard QR code reader.
  • Physical products are subject to normal wear and may degrade over time.
  • We are not responsible for damage caused by misuse, water exposure, or extreme temperatures.

7.4 Lost or Stolen Products

If your NFC product is lost or stolen, contact us immediately. We can disable the link to your profile to prevent unauthorized access. Replacement products must be purchased separately.

8. Custom Domains

8.1 Domain Ownership

You retain full ownership of any custom domain you connect to klikcard. We do not register or manage domains on your behalf.

8.2 DNS Configuration

To use a custom domain, you must configure your domain's DNS records as specified in your klikcard dashboard. Incorrect DNS configuration may result in your profile being inaccessible.

8.3 Domain Approval

All custom domain requests are subject to approval. We may reject domains that:

  • Violate trademark or intellectual property rights.
  • Contain offensive or inappropriate content.
  • Are used for phishing, malware, or illegal activities.
  • Misrepresent affiliation with klikcard or klikcard.

8.4 Domain Removal

We may remove custom domain connections if your subscription expires or if the domain violates these Terms. Your profile will remain accessible via the default klikcard subdomain.

9. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable local, national, or international law.
  • Transmit spam, unsolicited communications, or promotional content to users who have not consented.
  • Attempt to gain unauthorized access to any part of the Service or other users' accounts.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Use automated systems (bots, scrapers) to access the Service without permission.
  • Create profiles for fraudulent, deceptive, or misleading purposes.
  • Distribute malware or engage in phishing or other cyberattacks.
  • Harass, abuse, or harm other users or individuals.
  • Circumvent any security measures or access controls.
  • Resell or redistribute the Service without authorization.

Violation of this policy may result in account suspension or termination without refund.

10. Intellectual Property

10.1 klikcard Property

The Service, including its original content, features, functionality, logos, graphics, and trademarks, is the property of klikcard and is protected by international copyright, trademark, and other intellectual property laws.

10.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms.

10.3 Feedback

If you provide suggestions, feedback, or ideas regarding the Service, you agree that we may use such feedback without any obligation to compensate you.

11. Termination

11.1 Termination by You

You may terminate your account at any time through your account settings or by contacting us. Upon termination:

  • Your profiles will be deactivated and inaccessible.
  • Your User Content may be deleted.
  • Any active subscriptions will be cancelled without refund.

11.2 Termination by Us

We may suspend or terminate your account at any time if:

  • You violate these Terms.
  • We receive credible reports of abuse or illegal activity.
  • Your account remains inactive for an extended period.
  • We discontinue the Service (with reasonable notice).

11.3 Data Deletion

Upon account termination, your personal data will be handled in accordance with our Privacy Policy. You may request data export before termination.

12. Disclaimers & Limitation of Liability

12.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 No Guarantee

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any data loss or corruption.

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, klikcard SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

12.4 Maximum Liability

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Morocco. You agree to submit to the personal jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via:

  • Email to your registered email address.
  • Notice displayed within the Service.
  • Update to the "Last updated" date at the top of this page.

Your continued use of the Service after such changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
